Welcome to Phantom Calls. These Terms & Conditions (“Terms”) govern your access and use of the Phantom Calls platform (“we”, “us”, “our”). Please read them carefully before using our services.

By accessing or using Phantom Calls, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree with any part, you must discontinue use of the service immediately.

1. Eligibility

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to use Phantom Calls. By using our service, you represent and warrant that:

- You meet these eligibility requirements,

- You are fully able and competent to enter into these Terms, and

- Your use of the service is in compliance with all applicable laws and regulations.

2. Account Registration

To access certain features, you must create an account using Supabase Auth. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We are not liable for unauthorized access caused by your failure to safeguard this information.

3. User Responsibility

You are solely responsible for any data, scripts, voice configurations, phone numbers, or call content you initiate through the platform. We do not monitor the legality, morality, or consequences of your actions. You agree not to use the service:

- For illegal, unethical, or fraudulent activities,

- To impersonate others or misrepresent your identity,

- To harass, spam, threaten, or defraud third parties.

Violation of this section may result in immediate termination of your account and possible legal action.

4. Payments, Fees & Billing

Usage of the service is metered and billed in real time based on:

- Call duration (per second or per minute),

- Selected premium features,

- Voice parameters and channel types.

Payments are made in cryptocurrency via third-party processors (e.g., NOWPayments). All transactions are final and non-refundable. We are not responsible for failed or delayed crypto transfers due to third-party services or blockchain network conditions.

5. Availability & Modifications

We strive to maintain uptime and availability but make no guarantees regarding:

- 24/7 uninterrupted service,

- Real-time responsiveness or processing speed,

- Bug-free or error-free experiences.

We reserve the right to modify, suspend, or discontinue any feature or functionality of the service at any time without prior notice.

6. Intellectual Property

All rights, title, and interest in the platform, including but not limited to software, branding, and proprietary algorithms, remain our sole property. You may not reproduce, reverse-engineer, copy, or exploit any part of the service without written permission.

7. Indemnification

You agree to indemnify, defend, and hold harmless Phantom Calls and its affiliates from any claims, liabilities, damages, or costs (including legal fees) arising from:

- Your misuse of the service,

- Your violation of these Terms,

- Your breach of any rights of another party.

8. Acceptable Use Policy

You must not use the service to:

- Send automated spam calls without consent,

- Violate international sanctions or telecommunications laws,

- Circumvent rate limits or system restrictions,

- Harm or interfere with third-party networks.

9. Disclaimers

Phantom Calls is provided "as is" and "as available." We disclaim all warranties, express or implied, including but not limited to:

- Fitness for a particular purpose,

- Accuracy or completeness,

- Security and non-infringement.

We are not responsible for damages caused by errors, outages, or unauthorized access.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

- Any indirect, incidental, special, or consequential damages,

- Loss of data, profits, revenue, or business opportunity,

- Any claim exceeding the total amount you paid to use the service in the last 30 days.

11. Termination

We may suspend or permanently terminate your access at any time for any reason, including but not limited to:

- Violation of these Terms,

- Abuse of the platform,

- Requests by law enforcement.

Termination may result in data loss and forfeiture of any remaining balance.

12. Governing Law

These Terms are governed by and construed under the laws of the jurisdiction in which Phantom Calls operates. Any disputes shall be resolved exclusively in competent courts of our chosen legal venue.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining Terms shall remain in full force and effect.

14. Changes to These Terms

We reserve the right to revise these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the platform constitutes your acceptance of the revised Terms.
